Guillermo Franco?

Currently he plays for the Hammers but strangely on FIFA 10 he's on the Mexican National Football Team and not with West Ham; how could I tranfer him?

You can't. He signed for West Ham after the Premier League Transfer window closed which was the cut off date for Fifa 10.

Everton's Lucas Neill is in a similar boat, on the Aussie squad but not on Evertons roster.
